Steps to Take After an Arrest

Few people know what to do when they are arrested until it actually happens. Hopefully that never becomes necessary for you; however, if it has happened to you or to someone you know, it is important that you know what steps to take.

Long Law PLLC can provide the counsel, guidance, and defense that you need after you have been arrested. Read through the five steps below for basic information before you consult an attorney. You cannot wait to hire a lawyer – every moment you waste without defense raises your chances of incrimination and a criminal conviction. Call now at (248) 792-0439 if you need a criminal defense attorney in Oakland, Michigan.

1. Know Your Rights

Everyone has rights, including when they are arrested. You have the right to remain silent and the right to an attorney. You also have the right to be treated with respect as long as you are respectful of law enforcement during your arrest. You should not be the victim of unnecessary or excessive force, or of unnecessary verbal abuse.

2. Be Respectful

To help ensure that you are treated respectfully, you must be sure to speak and act respectfully toward your arresting officer(s). Using foul or abusive language, verbal or physical threats, or simply having a bad attitude can encourage the officers to treat you poorly. It also does not help your defense in a court of law.

3. Do Not Resist or Flee

Regardless of whether you are innocent or not, never fight back or run away. Resisting arrest is a crime, as is fleeing law enforcement. Do you want to fight your charges? Comply with your arresting officers and call a lawyer.

4. Remain Silent

One of your most important rights is the right to remain silent. DO NOT speak to your arresting officers. They ask you questions and make it seem like you're required to answer them – YOU ARE NOT. You have the right to respectfully refuse to answer any questions until you have a lawyer by your side.

5. Call a Lawyer

The sooner you retain an attorney, the better your chances will be of a successful defense. Attorney Emily Long, founder of Long Law PLLC, has handled numerous successful defense cases and can skillfully fight your charges, whatever they may be. By having an attorney of your choice on your side, you will have reliable counsel to prevent you from saying anything that could be used against you during your trial. You can also have peace of mind knowing that you have a capable attorney defending you.
